The Collaborate4Kids website (our “Website” is operated by Collaborate4Kids, LLC, a Florida limited liability company (“Collaborate4Kids” or “we” or “our”). These Terms of Use (this “Agreement” or “Terms”) state the terms and conditions under which you may use, access or browse the Website and govern your use of the Website. By using the Website, you (“user”, “you” or “your”) agree to be bound by this Agreement, whether you are simply accessing or browsing the Website, uploading content, purchasing or licensing content and other products/materials offered on the Website (“Products”) as a registered user (“Member”). If you wish to use this Website, please read this Agreement carefully. If you object to anything in this Agreement, the Collaborate4Kids Privacy Notice or any other policies referred to in this Agreement, you should leave and discontinue use of the Website immediately.
ACCEPTANCE OF TERMS OF USE AGREEMENT
a. | Electronic Agreement/Modification.This Agreement is an electronic contract that sets out the legally binding terms of your use of the Website. By accessing the Website, ordering or purchasing Products and/or becoming a Member, you consent to have this Agreement provided to you in electronic form, accept this Agreement and agree to the terms, conditions and notices contained or referenced herein. This Agreement includes Collaborate4Kids’s Privacy Notice, other policies referenced herein and any notices regarding the Website. By accessing the Website and/or clicking the “I have read and agree to the Collaborate4Kids Terms and Condition” Button, you accept this Agreement and agree to the terms, conditions, policies and notices contained or referenced herein. |
b. | Modification. This Agreement, the Privacy Notice and any other policies referenced by this Agreement may be modified by Collaborate4Kids at its sole discretion from time to time, such modifications to be effective upon posting by Collaborate4Kids on the Website and your use of the Website after such posting will constitute acceptance by you of such changes. Please consult this Agreement regularly. This Agreement was last updated on August 15, 2024. |

ELIGIBILITY. You must be at least eighteen (18) years of age to purchase Products, register with or otherwise use the Website. By using the Website, you represent and warrant that: (a) you have the right, authority and capacity to enter into this Agreement and to abide by all of the terms and conditions of this Agreement; (b) all registration and listing information you submit is truthful and accurate; (c) you will maintain the accuracy of such information; (d) you are 18 years of age or older; and (e) your use of the Website does not violate any applicable law or regulation.
MEMBER Subscription/License. Subject to the terms and conditions of this Agreement, Collaborate4Kids hereby grants to Member a limited, non-exclusive, non-transferable license to access and use the Website during the subscription term (the “Subscription”). The applicable Subscription plans, associated fees and term of Subscription will be selected by Member during Member’s registration with the Website or during any subsequent purchase. By agreeing to grant such license, Collaborate4Kids does not obligate itself to maintain the Website in its present form. Collaborate4Kids may upgrade, modify, change or enhance the Website upon reasonable prior notice to Member (unless the change is of critical business importance or outside Collaborate4Kids’s control, in which case Collaborate4Kids will explain the reason for the changes as soon as is reasonably practicable).
AUTO RENEWAL. Your Subscription may automatically renew under this Agreement. Your Subscription will continue for the length of the initial term you select on your plan and at the end of your prepaid Subscription, it will automatically renew for additional prepaid periods of the same length unless you choose to cancel at least 24 hours prior to that renewal. In order to cancel your Subscription you must contact us at cancelsubscription@collaborate4kids.com. Your account will automatically be charged (or you will be billed, as Applicable) at the rates in effect at the time of renewal.
LICENSE RESTRICTIONS. Collaborate4Kids reserves all rights not expressly granted to Member. Member will not copy, export, transmit electronically, download electronically or in hard copy, post to a database or to the Internet, or otherwise reproduce in any fashion any portion of the Website, or its underlying content, software, applications, reports or databases or any substantial portion thereof, except as expressly authorized in this Agreement. Except as expressly authorized in this Agreement, Member shall not: (a) use, copy, reproduce, export, merge or transfer copies of the Website; (b) rent, lease, sublicense, distribute, transfer, copy, modify or timeshare the Website or any of Member’s rights under this Agreement; or (c) use the Website or any part of it after any expiration, termination, or cancellation of this Agreement or the license granted by this Agreement. You agree to prevent any unauthorized copying of the Website or its content. You also agree not to transfer any access privileges to the Website or its materials/content to any third parties. As a condition of your use of the Website, you warrant to Collaborate4Kids that you will not use the Website for any purpose that is unlawful or prohibited by this Agreement. You may not use the Website in any manner which could damage, disable, overburden, or impair the Website or interfere with any other party’s use and enjoyment of the Website.
PRODUCTS/LISTINGS. Please click here for more information about our membership and listing policies. If you want to create a profile/listing, you must truthfully and accurately fill out all required information during sign up. When you create a profile/listing and upload content (such as texts, videos or photographs) to the Website, you agree to grant Collaborate4Kids a non-exclusive, non-commercial license to use and display such content. You are responsible for the accuracy and content of your profile/listing. You represent and warrant that any material or information that you post does not violate the intellectual property rights or confidentiality rights of others. Collaborate4Kids reserves the right to terminate your profile or access to the Website for any reason (see Termination of Use below).
FEES/PAYMENT METHODS/TAXES. Collaborate4Kids charges service fees per online transactions, as well as subscription fees. Collaborate4Kids establishes the amount of such fees directly with Members. Member agrees to pay all applicable fees for our services. We may change our fees from time to time by notifying Members of such changes in advance. Collaborate4Kids utilizes third party companies, such as Stripe (https://stripe.com/) and PayPal (https://PayPal.com), to handle credit card, payment and bank account transactions between Members. Collaborate4Kids is not responsible for such transaction. No sensitive payment information (e.g. credit card numbers, bank account numbers, etc.) is stored on our servers. Therefore the burden of PCI Compliance rests solely on Stripe and PayPal. Since each transaction and the actual purchase agreement is directly between the users of this website, Collaborate4Kids is not responsible paying any taxes related to such transaction. It is your sole responsibility to determine and pay any taxes (sales tax or otherwise) that may be relevant.
REFUNDS/DISPUTE POLICIES. If a Member is dissatisfied with products it has purchased or licensed from another Member or contests any charges, such Member must notify in writing both the other Member and Collaborate4Kids within five (5) business days of receipt of such products. Since each transaction and the actual purchase agreement is directly between the users (i.e. Members), Collaborate4Kids is not responsible for refunds or disputes that may occur between such users. Disputes will be the sole responsibility of the users to resolve. Collaborate4Kids may provide a Member’s contact information for communication between the disputing parties to facilitate resolution, but has no liability for unresolved issues. You agree to allow Collaborate4Kids to release your contact information to facilitate settlement of order discrepancies and disputes. You acknowledge that any chargebacks are governed per the terms of Stripe, PayPal or the relevant card brand.
COLLABORATE4KIDS’S ROLE/NO ADVICE. Your interactions with other Members, users, organizations or individuals (such as referral sources) found on or through the Website are solely between you and such organizations and/or individuals. The information provided on this Website is for reference use only, and does not constitute the rendering of legal, clinical, mental health, medical, financial, or other professional advice or recommendations by Collaborate4Kids. Collaborate4Kids expresses no opinion as to the quality or reliability of other parties or the products/services they offer, including curriculum offered or information contained in profiles or otherwise listed on this Website. Nothing on the Website is a comment on the legitimacy, suitability or quality of such products/services. Collaborate4Kids has no control over and does not guarantee the existence, quality, safety or legality of products/services offered or advertised; the truth or accuracy of other user content or listings; or the accuracy of the information provided by users or other third parties. Before relying on and accepting any information you’ve read about on Collaborate4Kids, you should confirm with the third party any information that is important to you. This should include the background and professional status of the other person. Collaborate4Kids does not conduct any background checks on such third parties or any users of this Website or verify the information contained on user profiles. Reliance on any opinion, information or materials is done at your own risk.
ACCEPTANCE OF RISKS. You are solely responsible for making any decisions regarding third party transactions related to the purchase/sale of Products or services. You expressly acknowledge that you are making all of your own decisions in connection with such transactions and that Collaborate4Kids is not making recommendations with respect to individuals, companies, Products or services offered or with respect to any information you disclose or communications that you make on this Website. You also expressly acknowledge that you are subject to a variety of risks related to third party transactions and information that you post or share, which risks are beyond the control of Collaborate4Kids, and you expressly acknowledge that Collaborate4Kids is not liable or responsible for those risks, for which you have sole responsibility. You agree to take all necessary precautions in all interactions with third parties or any other Members/users of this Website, particularly if you decide to communicate off the Website or meet in person, or if you decide to purchase products/services or send money to such individual/entity.
WEBSITE CONTENT. Occasionally there may be information on the Website that contains typographical errors, inaccuracies, or omissions that may relate to product descriptions, pricing and/or availability. Collaborate4Kids reserves the right to correct any errors, inaccuracies or omissions and to change or update information at any time without prior notice (including after you have submitted your order). Collaborate4Kids apologizes for any inconvenience this may cause you.
We encourage you to let us know of any material on our Website that you believe to be inappropriate, false and/or inaccurate. Please forward a copy of the material in our Contact Us form along with an explanation of your concerns.
ELECTRONIC COMMUNICATIONS. When you visit the Website or send e-mails to Collaborate4Kids, you are communicating electronically. You consent to receive communications from Collaborate4Kids electronically. Collaborate4Kids will communicate with you by e-mail or by posting notices on the Website. You agree that all agreements, notices, disclosures and other communications provided to you electronically satisfy any legal requirement that such communications be in writing. You also agree that by registering with Collaborate4Kids, you consent to receive newsletters, emails, promotions, social media communications and other advertisements from Collaborate4Kids or its partners. You agree that you understand the risks of electronic communications and you accept such risks.

- Publish, post, upload, distribute or disseminate any inappropriate, confidential, profane, defamatory, infringing, vulgar, obscene, indecent or unlawful topic, name, material or information.
- Use language or content that discriminates based on race, creed, age, color, religion, gender, marital status, national origin, income level, physical or mental disability, sexual orientation or any other form of discrimination.
- Language or content that is generally inappropriate, inaccurate, in poor taste or otherwise contrary to Collaborate4Kids’s values and mission.
- Upload files or content that contain software or other material protected by intellectual property laws (or by rights of privacy of publicity) unless you own or control the rights thereto or have received all necessary consents.
- Upload files that contain viruses, corrupted files, or any other similar software or programs that may damage the operation of another’s computer.
- Advertise or offer to sell or buy any goods or services for any business purpose, unless such Communication Service specifically allows such messages.
- Conduct or forward surveys, contests, pyramid schemes or chain letters.
- Download any content or file posted by another user of a Communication Service that you know, or reasonably should know, cannot be legally distributed in such manner.
- Falsify or delete any author attributions, legal or other proper notices or proprietary designations or labels of the origin or source of software or other material contained in a file that is uploaded.
- Restrict or inhibit any other user from using and enjoying the Communication Services.
- Violate any code of conduct or other guidelines which may be applicable for any particular Communication Service.
